This information includes new product and service offerings, event listings, legislative and legal updates, and more.
HOLIDAY SCHEDULE
HRPLUS and STAT America will be closed on Memorial Day (Monday, May 26), and Independence Day (Friday, July 4). Most employers, courts, schools, state offices, licensing boards, and laboratories will also be closed. Please try to submit your orders early and avoid running into roadblocks caused by holiday closings. Even though we will be closed on these days, background reports and drug-test results are viewable on the HRPLUS and STAT America Web sites 24 hours a day, 7 days a week.

NEW SERVICE: FOOD AND DRUG ADMINISTRATION DEBARMENT SEARCH
If your company employs physicians and other qualified experts who participate in clinical research in accordance with the Food and Drug Administration (FDA), it is advisable to conduct a search of the FDA's debarment database for clinical investigators when screening applicants. The FDA database lists individuals who are no longer allowed to participate in FDA-mandated research, in addition to listing individuals who may have restrictions or have been disqualified from conducting FDA research. LEGAL COMPLIANCE: THE IMPORTANCE OF THE SIGNED AUTHORIZATION
The Fair Credit Reporting Act (FCRA) requires that all employers have a signed authorization from an applicant before beginning the background investigative process. To ensure that this legal requirement is met, HRPLUS requires a copy of the signed authorization before starting any background report request. Requiring the signed authorization reduces the chances that the background check is being used for fraudulent purposes. Providing the signed authorization up-front can also decrease the turnaround time for background reports, because frequently, many information sources (e.g. educational institutions) require a signed authorization prior to the release of information.
NEW SERVICE: HEALTHCARE PROFESSIONAL TESTING PANELS
For employers in the pharmaceutical and healthcare industries, STAT America offers extensive drug-testing options. Traditional drug tests screen for only 5 to 10 drugs, leaving many prescription drugs undetected. Healthcare professionals often have access to commonly prescribed drugs that can be abused, and it may be advisable to screen applicants and employees by using expanded drug-testing panels. These specialty panels, commonly known as healthcare professional panels, can test for up to 40 commonly prescribed drugs, in addition to the more commonly abused drugs such as marijuana and cocaine. Although this panel is not necessarily recommended for most corporate drug-testing programs, employers in the healthcare industry should consider this testing option. SERVICE SPOTLIGHT: ECSTASY TESTING
The designer drug ecstasy (MDMA) is becoming a genuine concern for employers, as its presence away from the "rave scene" is becoming more common. The number of adults who have used the illegal drug at least once in 2000 increased by 25% over the previous year, according to the most recent U.S. Department of Health and Human Services National Household Survey on Drug Abuse. As ecstasy use continues to grow, it is important to protect your workplace from its effects. STAT America now offers ecstasy screening through laboratory urine- and hair-testing programs, in addition to rapid on-site urine-testing products. It is simple to add ecstasy screening to an existing laboratory urine drug-testing panel. Ecstasy testing will not affect the turnaround time for the reporting of results. DOT TESTING: DO YOU NEED IT?
The federal Department of Transportation (DOT) has specific requirements detailing what type of vehicular activities require federally-mandated drug testing. Often, employers assume that any employee who is required to either drive company vehicles or possess a commercial driver's license is subject to drug-testing programs pursuant to DOT regulations. However, that is not always the case. Although it is advisable to drug test any employee or applicant who is in a safety-sensitive position, certain types of vehicular activity may not warrant DOT testing. Vehicles with a gross weight of less than 26,000 pounds and vans transporting less than 15 passengers generally do not require DOT testing. In addition, federal testing programs have specific requirements about the reporting of the drug-test results that can cause reporting delays and, more importantly, potentially increase the cost of your drug-testing program. PROTECTING EMPLOYERS, EMPLOYEES AND APPLICANTS FROM IDENTITY THEFT
The Federal Bureau of Investigation lists identity theft as one of the fastest growing crimes in America. In a document titled "Criminal Intent: The Top 10 Underlying Causes of Credit Fraud and Identity Theft," TransUnion, one of the nation's three major credit bureaus, lists the theft of employee records as one of the primary contributors to this problem.
Identity theft, defined as using another individual's personal information to commit fraud, can be the result of something as simple as a stolen wallet. However, identity theft can also happen on a much larger scale, especially when businesses and institutions are not careful in the handling of employee and applicant personal information.
As employers requesting and retaining sensitive employee and applicant personal information, it is important to take reasonable steps to ensure that this information is stored safely and handled responsibly. Companies with inadequate policies and procedures regarding personal information could be subject to claims of legal liability from employees and applicants, in addition to negative publicity.
The sharing of individual personal information is rapidly increasing, and only by working together will we be able to protect your employees and applicants from possible identity theft.
